1. Purpose and Scope
This Acceptable Use Policy (“AUP”) governs the use of the cloud computing, hosting and virtual server services provided by MINIVPS.
Failure to comply with these provisions may result in the immediate suspension or permanent termination of the services, without prejudice to any applicable legal measures.
2. Illegal or Unauthorized Use
Using the services for illegal activities or activities that violate current Brazilian law is expressly prohibited, including but not limited to:
- Infringement of copyrights, trademarks or intellectual property;
- Distribution, storage or provision of illegal content;
- Sexual exploitation of children and adolescents;
- Fraud, deceptive schemes or unlawful activities;
- Trafficking of drugs, weapons or any criminal activities.
3. Information Security
The customer is fully responsible for the security of its systems, applications, access credentials and data.
MINIVPS is not responsible for intrusions, compromised servers, vulnerable scripts or security flaws resulting from improper configuration or omissions by the customer.
4. Spam and Bulk Email
Sending unsolicited electronic messages (“spam”) is prohibited, as is any practice that violates email best practices or applicable law.
Bulk email is only allowed with prior authorization from MINIVPS, provided the customer demonstrates:
- Express and verifiable consent from recipients;
- A working unsubscribe mechanism (opt-out);
- Clear identification of the sender;
- Compliance with applicable Brazilian law.
5. Network Abuse and Malicious Activities
Any activity that compromises the stability, security or availability of the network is prohibited, including but not limited to:
- Unauthorized scans, exploitation of vulnerabilities or attacks;
- Botnets, malware, ransomware or malicious code;
- Denial-of-service attacks (DoS/DDoS);
- Interfering with the operation of other customers;
- Spoofing of packets, headers or identities.
6. Resource Usage
Excessive or abusive use of resources that compromises the performance or stability of the infrastructure may result in throttling, suspension or termination of the service.
7. Responsibility for Content
The customer is solely and exclusively responsible for all content hosted, transmitted or processed through the contracted services.
8. Enforcement and Measures
MINIVPS may, at its discretion, take technical and administrative measures to investigate suspected violations of this AUP, including preventive suspension of the services.
9. Changes to this Policy
This Acceptable Use Policy may be changed at any time by publishing an updated version on the official MINIVPS website.
10. Final Provisions
This AUP is part of the MINIVPS Terms of Service and must be read together with the SLA and the Privacy Policy.
